The following terms apply to your participation in the DISH Refer-A-Friend Program (“Program”) offered by DISH Network L.L.C. (“DISH” or “we”). By participating in the Program, you agree to comply with these terms (“Program Terms”).

The Program is separate from any other rewards or loyalty program previously or currently offered by DISH, and is subject to the Residential Customer Agreement (“RCA”) you entered into with DISH. These Program Terms do not alter in any way the terms or conditions of any other agreement you may have with DISH for products, services, or otherwise, including, without limitation, the RCA. The RCA is incorporated by reference herein and contains additional terms and conditions. The RCA is available online at dish.com/service-agreements.

You and DISH agree that any and all disputes arising out of, relating to, or concerning the Program will be resolved through mandatory and binding arbitration pursuant to the terms and conditions set forth in the RCA.

The Program is a points-based referral program operated by DISH where you can earn points by referring friends and family to sign up for DISH services and products. See How To Earn Points for more details. Points can be redeemed for rewards using the MyDISH app or visiting https://my.dish.com/refer. By participating in the Program, you authorize DISH to collect, maintain, use, process, and share their information, including, without limitation, names, email addresses, physical addresses, account and other information in accordance with DISH’s Privacy Policy. 1 ) WHO CAN PARTICIPATE?

By enrolling in the Program, you are accepting the Terms, and agree that you: Are at least 18 years old. Read and understood these Program Terms. Are a Current DISH subscriber in good standing with a MyDISH account. Are a resident of the United States (certain restrictions may apply for residents of US territories or otherwise in accordance with applicable local law)If you do not agree to the Program Terms, you must stop participating in the Program.

2 ) YOU MUST DISCLOSE YOUR RELATIONSHIP WITH DISH.

Every time you refer someone to DISH, you must tell that person that you will receive points if they sign up as a DISH subscriber. Telling people you refer that you earn points is a legal requirement. Failure to comply may result in losing your points and may be a violation of laws enforced by the Federal Trade Commission. You can use the default language provided to share referral code, but at least use: "I get free points if you subscribe using my referral code.”

3 ) YOU ARE RESPONSIBLE FOR YOUR COMMUNICATIONS / YOU MAY NOT USE DISH TRADEMARKS WITHOUT DISH’S PERMISSION.

You are limited in the way you may talk/write about the Program. You must create and distribute any e-mail, social media, or other communication providing a referral invitation in a personal, non-commercial manner that is appropriate and customary for communications with friends and family members. Bulk e-mail distribution, distribution to strangers, or any other promotion of your personal referral link or code that would constitute, or appear to constitute, unsolicited commercial e-mail or spam under any applicable law or regulation is a violation of these Program Terms and may result in your immediate termination from the Program, disqualification from future participation, and forfeiture of any rewards accrued to you as a result of participation in this Program, but not yet redeemed. You must not, without DISH’s written permission, include any DISH trademarks or other DISH materials in your communications (unless as otherwise provided by DISH to you) about this Program and you must not use any domain names or e-mail addresses that include DISH, its marks or its web site URLs. The content of all your communications about this Program must be yours alone. Do not misrepresent or embellish your relationship with DISH or write, say or post anything you know is untrue or may be misleading. Do not make performance, price or other claims about DISH services. And, if someone has asked you to stop sending them messages about DISH, respect that wish. You should not send referrals to people that you do not personally know.

4 ) WHAT IS A QUALIFIED REFERRAL?

Subject to the sole discretion of DISH, you may earn one hundred (100) points for each Qualified Referral. A “Qualified Referral” is defined as a verified new DISH subscriber who arrived at mydish.com/refer via your unique referral link or has provided your unique referral code to DISH at the time they sign up for service and who is a new customer with DISH (meaning has not been a DISH subscriber for a least ninety (90) days before being referred), activates new DISH Satellite Television service, and maintains a DISH Account in good standing for three (3) months. You earn the points at the referrals service activation, but if they cancel before the third full month of their service, DISH may take back the points. You will not receive a reward if your referrals are not considered in good standing for any reason (including, if the referred friend does not satisfy the requirements to be considered a Qualified Referral). This Program cannot be used in conjunction with any other offer by DISH. DISH Services are not available everywhere so your referral might not be able to sign up for DISH Services. You cannot refer yourself or refer your own accounts. DISH employees, sales agents and their immediate family members may not be eligible to refer or participate in Program, as determined by DISH at any time.

5 ) DEPOSIT OF REFERRAL POINTS.

Points that are legitimately earned will be deposited in your MyDISH account. By participating, you agree that the statistics DISH may choose to display through the Program site may not be real-time or accurately reflect the points you actually earned. DISH will have no liability for any typos or errors displayed in those statistics.

6 ) POINTS EXPIRE.

All points you earn in the Program may expire as determined by DISH and communicated to you in advance prior to expiration in the event that DISH terminates the Program.

7 ) MAXIMUM POINTS.

You will not earn points for referring more than ten (10) Qualified Referrals in any given twelve (12) month timeframe. You will stop earning additional points for Qualified Referrals until the number of Qualified Referrals your refer in the last twelve months falls below ten (10). Points have no fixed or cash value and can only be used to claim rewards. Points earned may not be sold, assigned, or transferred to another MyDISH account. Any sale or barter involving your points will void them completely. Check your MyDISH account for details about expiration dates that may apply to points and rewards.

8 ) NO FRAUDULENT ACTIVITY.

DISH reserves the right to void referrals and points earned if it suspects that the referral points were earned in a fraudulent manner, in a manner that violates these terms, or in a manner otherwise not intended by DISH. DISH has the right to monitor your Program activity. If your activity shows signs of fraud, abuse, or suspicious activity or any misuse of the Program or your Program account, you may lose your accumulated points, and, as a result of this activity, the DISH may close your Program account immediately.

10 ) COMPLY WITH THIRD PARTY REQUIREMENTS.

You agree that you will not post your unique referral link or otherwise promote the Program on a web site or other outlet that prohibits that activity.

11 ) NO ILLEGAL OR UNSPORTSMANLIKE PARTICIPATION.

You agree that you will not participate in this Program in a threatening, abusive, illegal or unsportsmanlike manner. This Program is not targeted towards, nor intended for use by, anyone under the age of 18.

12 ) WE WILL SEND YOU E-MAILS ABOUT THE PROGRAM.

You may receive e-mails about this Program, including an e-mail each time a person you refer becomes a Qualified Referral.

13 ) VOID WHERE PROHIBITED/CANCELATION/MODIFICATION.

The Program is void where prohibited and DISH may cancel or modify these terms or the Program at any time. You or DISH may, at any time, end your participation in the Program by giving DISH notice of your withdrawal from the Program, at which point you will no longer be able to earn points even if you have future Qualified Referrals.

14 ) YOU RELEASE US FROM LIABILITY.

By participating in the Program, you agree that you are participating at your own risk and that DISH will have no liability and that you will indemnify and hold DISH harmless for any claim, action, liability, loss, injury, or damage to you or any other person or entity due in whole or in part, directly or indirectly, by reason of your participation in the Program. You will not settle any claim without the prior written consent of DISH. Further, you agree that DISH is not responsible for faulty referral links; taxes associated with rewards you redeem; any error, omission, interruption, defect, or delay in transmission, order processing, or communication; technical or mechanical malfunctions; errors in these Program Terms, in any Program-related materials; human-processing error; failures of electronic equipment, computer hardware or software; damage to your equipment, computer hardware, or software; or inaccurate information, whether caused by equipment, programming, human error, or otherwise. UNDER NO CIRCUMSTANCES WILL DISH BE LIABLE TO YOU FOR ANY LOSS OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, FOR ANY DIRECT, INDIRECT, ECONOMIC, EXEMPLARY, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL LOSSES OR DAMAGES) THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE PROGRAM. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

15 ) COLORADO LAW GOVERNS THESE TERMS.

The Program and all matters relating to its validity, construction, performance, and enforcement, and any claim, complaint or dispute (including, without limitation, any Dispute) arising out of, relating to, or in connection with any aspect of this Agreement, the Services, or the Equipment shall be governed by the laws and regulations of the State of Colorado without giving effect to its conflict of law provisions. ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE WITH RESPECT TO THE PROGRAM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION ARISES.

16 ) REWARD TERMS.

Each reward may have its own terms that apply, which may include an expiration date or require you to share information with the company offering the reward. Rewards may be personalized based on information we have about you and not all rewards are available in all areas of the United States. We are not responsible for any content or rewards provided by any rewards partner. The information provided to the rewards partner to claim or use a reward is subject to the privacy policy of the rewards partner. When you claim and use a reward, you release DISH and all its affiliates from liability for your use of the points, for the reward and how you use it, and for your participation in the Program. All calculations made in connection with the Program, including without limitation, the value of any benefits, the availability of previously available rewards, and the earning and accumulation of points, will be made by DISH in its discretion at any time and such calculations will be considered final. Only one reward may be redeemed per transaction, all redemptions are final, and you are not entitled to any refunds or returns of redeemed points.

17 ) TERMINATION OR CHANGE TO YOUR DISH ACCOUNT.

If you terminate your DISH Account or Services, your Program account will be closed and you forfeit any points and rewards in your account. We can suspend or terminate your account at any time. You may lose points in your account if your DISH account status changes, you fail to make payments on your DISH account, we suspect fraudulent activity, or we make changes to the Program. We may change these Program Terms at any time. DISH may, among other things, withdraw, limit, modify, or cancel any points; increase the points required for any award; modify benefits or rewards associated with the Program; modify or regulate the transferability of awards or benefits; or limit the number of awards available. You may not rely upon the continued availability of the benefits associated with the Program and you may not be able to obtain all offered benefits or awards. You may access the Program Terms on the MyDISH to review changes to the Program or the Program Terms. You waive any right you may have to receive specific notice of such changes or modifications. If you continue to remain in Program after the program or Program Terms change, it means you are accepting the changes to the Program and the Program Terms.

Phone Service:

 

Phone services are governed by tariffs, where required by law, or the terms and conditions described in the Customer Service Guide for your state. The appropriate document for your state can be found at https://webapps.dish.com/legal/wireline. Taxes, fees and surcharges apply, including a Federal Access Charge, Carrier Access Charge and state and local fees that vary by area and certain in-state surcharges. Taxes, fees and surcharges apply based on standard monthly invoice for telephone service. Our Nationwide calling and .05 per minute long distance plans apply to the 48 contiguous United States only. dishNET Wireline reserves the right to move a customer from the Nationwide Calling plan to the $.05 per minute long distance plan without notification if the usage on the Nationwide Calling plan does not resemble typical residential usage. Updated rates for locations other than the 48 contiguous United States are available by giving us a call.



Phone and Video Bundle Offer:

 

A bundle credit of $10 per month applies to the account as long as phone and DISH Video service are maintained. If a service is terminated, bundle credits will be reduced or cancelled depending upon the Services remaining on the account.

DISH supports every fan's right to express themselves openly, and as such, will not remove/hide any content or posts unless they violate the following rules or the Terms of Use for the associated Social Media platform. Our Social Media pages are staffed by DISH Employees who will respond and post as the page itself. The Social Media platforms referenced may include but are not limited to Facebook, Google+, Instagram, Twitter, and YouTube.


Follow the Golden Rule – Treat others as you would like to be treated. By treating others with respect we can turn our Social Media pages into a great community of support and conversation. Do not post any advertising, spam (ie: multiple posts of a similar nature), or information directing users off the page. Our page is a place to talk and discuss DISH, not refer people elsewhere. Do not knowingly post false and/or defamatory, threatening, abusive, hateful, harassing, potentially offensive, instigating, or sexually oriented content or content related to race, sex, religion, or politics. Do not post any content with the purpose of impersonating another individual. Do not post any content that violates any local, state, or federal laws. To keep our wall appropriate for all ages, refrain from using curse words, including abbreviations, acronyms, insinuations, or innuendos. Avoid spam-like, copy and pasting in your posts. Your opinions and comments should be in your own words, not someone else's. Do not disclose any private information or content that is not your own (or content/information you do not have the right to provide to the public) including:

  • Phone numbers, addresses or any other contact information on the wall
  • Trade secrets or confidential information
  • Copyrighted content
  • Account-specific offers
  • Any other content that violates the intellectual property of another individual or business
  • Do not place comments on posts/threads that do not pertain to the topic already being discussed. Please create a new post to create a new conversation

 

Violating our rules may result in a temporary ban under these circumstances:

  • Three or more violations within 24 hours
  • One violation if it is especially severe
  • Multiple temporary bans may result in a permanent ban

Taxes:

Subscribers who live in most jurisdictions have sales taxes and similar charges listed on their bills, in addition to their monthly charges. These taxes are imposed by the state on the purchase of goods and services, and they are not limited to DISH. In many states, DISH is required by law to collect these taxes from subscribers. These charges are as follows (italicized text reflects how this item appears on the bill):

  • Sales Tax: These are taxes imposed on the purchase of goods and services. The applicable rate is set by each state.
  • Florida (Communications Services Tax & Video Gross Receipts Tax): Florida imposes a 9.07% sales tax on the price of satellite service and a gross receipts tax of 2.37%. The law requires DISH to collect these taxes from subscribers.
  • Kentucky (Video Excise Tax): Kentucky imposes a 3.0% excise tax on the price of multichannel video programming services. The law requires DISH to collect this tax from subscribers.
  • Massachusetts (Video Excise Tax): Massachusetts imposes a 5.0% excise tax on revenues from the sale of satellite service. The law requires DISH to collect this tax from subscribers.
  • Tennessee (Satellite Sales Tax): Tennessee imposes an 8.25% tax on revenues from the sale of satellite services. The law requires DISH to collect this tax from subscribers.
  • Utah (Video Service Tax): Utah imposes a 6.25% tax on the price of multi-channel video and audio services. The law requires DISH to collect this tax from subscribers.

 

Other Taxes:

Subscribers who live in certain states will also see charges for certain gross receipts taxes. These charges are as follows (italicized text reflects how this item appears on your bill).

  • District of Columbia (Video Gross Receipts Tax): DISH is subject to a 10% tax on the value of the services we provide in D.C., as measured by the sale price.
  • Maine (Video Service Provider Tax): DISH is subject to a 6.0% tax on the value of the services we provide in Maine, as measured by the sale price.
  • Maryland (Service Provider Tax): DISH is subject to a 10.0% tax on gross receipts from the sale of boxing and wrestling broadcasts in Maryland.

Although these taxes are similar to other state taxes and fees, which are typically the responsibility of the customer, the states above have chosen to impose these taxes on DISH and other businesses who conduct business in each of the respective states. These taxes are imposed on DISH and are not imposed directly on subscribers. DISH is not required by law to add the charge to a subscriber’s bill.

 

State Tax Reimbursement Charges:

Subscribers who live in certain states have a state-specific tax reimbursement charge listed on their bills as part of their monthly charges. These charges are allocated uniformly, are shown as a fixed monthly amount and are subject to change. These charges are as follows (italicized text reflects how this item appears on your bill).

  • Connecticut (CT Gross Earnings Tax Reimburse): DISH is subject to a 5.0% tax on its gross earnings in Connecticut. The charge is currently $4.83 per month.
  • Delaware (DE Gross Earnings Tax Reimburse): DISH is subject to a 2.125% tax on its gross receipts in Delaware. The charge is currently $2.07 per month.
  • Kentucky (KY Gross Earnings Tax Reimburse): DISH is subject to a utility gross receipts tax of 2.4% on gross receipts from the sale of multi-channel video and audio programming services. The charge is currently $2.36 per month.
  • Ohio (OH State Surcharge): DISH is subject to a 0.26% tax on its gross earnings in Ohio. The charge is currently $0.34 per month for video and $0.25 per month for broadband.
  • Texas (State Cost Recovery Fee): DISH is subject to a 0.75% franchise tax for conducting business in Texas. The charge is currently $0.28 per month for video and $0.02 per month for broadband.
  • Puerto Rico (PR Receiver Property Tax): Puerto Rico imposes property tax on the cost of a leased receiver. The charge is currently $0.13 per leased receiver per month.
  • Puerto Rico (PR Cost Recovery Fee): DISH is subject to various taxes in Puerto Rico, including the business-to-business tax, volume of business tax, and corporate income tax. The charge is currently $4.85 per month.

 

A Political Message About These Taxes and Charges:

DISH would like to offer the same high-quality service to all subscribers at the same price nationwide. The gross earnings and gross receipts taxes described above, however, have significantly increased DISH’s cost of doing business in Connecticut, the District of Columbia, Delaware, Kentucky, Maine, Maryland, Ohio, Rhode Island and Texas. Rather than raise the cost of programming for all subscribers, DISH has chosen to recover this additional cost directly from subscribers who reside in those specific jurisdictions. DISH subscribers in those jurisdictions should consider contacting their governor and state representatives and urging them to repeal these taxes.

 

Federal Regulatory Fees

DISH collects the FCC Regulatory Fee to recover DISH’s direct costs in connection with the payment of Federal Communications Commission regulatory fees.

The Netflix service is provided to you by Netflix under the Netflix Terms of Use, which will be provided to you separately. The other services included in your DISH package are provided by DISH. In order to enjoy the Netflix service included in your package from DISH, you will need to activate Netflix. You will receive instructions on how to activate Netflix via email and/or text message.

Netflix Billing: You will be billed for Netflix by DISH immediately after it is added to your DISH package. If you already have an existing Netflix account, during activation you must link it to your DISH package to avoid separate charges. You will continue to be charged separately for any existing Netflix account until you link that account to your DISH package.

Existing Netflix Membership: If you link an existing Netflix account to your DISH package, and then cancel your DISH package, Netflix will automatically resume charging your existing payment method that they have on file.

Managing Netflix Account: If you wish to review or make changes to your Netflix membership please visit the ‘Account’ pages on the Netflix website or via MyDish.

Loss of Bill Credits: If you drop below the minimum DISH programming requirements, you will lose the credits to your DISH bill. If you pause your service, any remaining credits will be forfeited and your remaining DISH commitment will resume when your service is unpaused.

Netflix Promotional Offer End: When your DISH promotional offer including Netflix ends, you will continue to be billed by DISH for your Netflix subscription at the then-current retail price for your Netflix plan.

Information Sharing: DISH will share the email address and/or phone number registered to your DISH account with Netflix to facilitate your activation of the Netflix service included in your DISH service.
